The Department of Education (DOE) on Thursday announced it will end taxpayer subsidization of career, technical, and adult education programs for illegal immigrants.

The department said it is rescinding standards from the Clinton administration allowing illegal immigrants to access federal funds for those education programs, in violation of the Personal Responsibility and Work Opportunity Reconciliation Act (PRWORA). The Education Department’s new interpretive rule also makes clear that illegal immigrants do not have access to Pell Grants and student loans.

Multi-Agency Approach to Ending Benefits for Illegal Immigrants

The Education Department’s announcement is just one part of a team effort across multiple federal agencies. The departments of Agriculture, Labor, Justice, and Health and Human Services all made similar announcements Thursday. Together, they created a complete plan to enforce existing immigration laws.

These policy changes will save American taxpayers about $40 billion, according to administration officials. Each department found specific programs that will now be properly limited to citizens and legal residents.

Health and Human Services made similar changes, including restricting access to Head Start, an early childhood education program. “For too long, the government has diverted hardworking Americans’ tax dollars to incentivize illegal immigration,” said HHS Secretary Robert F. Kennedy Jr.

The real-world impact becomes clear when looking at examples like New York City, which has spent at least $3 billion housing migrants since 2022 – even putting some in luxury hotels like The Row. Last year alone, the city received $81 million from FEMA to help shelter migrants.

Correcting Decades of Administrative Overreach

The Trump administration’s actions fix nearly three decades of improper interpretations of federal law. When Congress passed PRWORA in 1996, it clearly limited eligibility for federal public benefits to U.S. citizens, permanent residents, and certain categories of “qualified aliens.”

However, the Clinton administration created a loophole in 1997 that exempted career, technical, and adult education programs from these restrictions. According to the Education Department, this interpretation “mischaracterized the law by creating artificial distinctions between federal benefit programs.”

Trump’s executive order noted that over the past thirty years, “numerous administrations have acted to undermine the principles and limitations directed by the Congress.” He specifically charged that his predecessor “repeatedly undercut the goals of that law, resulting in the improper expenditure of significant taxpayer resources.”

The Department of Education will begin enforcing its new interpretation on August 9, 2025. This gives states and schools time to adjust their policies to follow federal law.
