Obama-Era Judge Orders Trump to Preserve Biden Program, Letting in Thousands of Migrants

Ever feel like common sense just flew out the window? You see a problem. You know the solution. The people you voted for? They see it too. They try to fix it. Then, bam. Someone, somewhere, with a fancy title and a robe, says “Not so fast.” It’s enough to make you wonder who’s really running the show.

It’s a story as old as time, or at least as old as oversized government. Good people try to do good things. Elected leaders try to enact the will of those who put them there. But there’s always an “expert,” or a committee, or a judge, ready to tell everyone why it can’t be done. Or, worse, why it must be done their way. Even if their way makes no sense to anyone living in the real world.

So, an Obama Judge Decided to Rewrite Trump’s Immigration Plan… Again

Well, Americans, it’s happened again. U.S. District Judge Indira Talwani, an appointee of none other than Barack Obama, just threw a wrench in the works. President Trump has been clear. He wants to end the reckless Biden-era migrant parole programs. These are the ones letting hundreds of thousands into our country with little more than a promise. The President signed an executive order back on January 20th. He directed the government to end “all categorical parole programs” set up by the previous administration. A straightforward plan. A necessary one.

But Judge Talwani, from her perch in Massachusetts, thinks she knows better. On Wednesday, May 28th, she ordered the Trump administration to resume processing applications for these very programs. We’re talking about migrants from Afghanistan. From Latin America. From Ukraine. The ones President Trump rightly identified as needing a closer look. She rejected the administration’s perfectly reasonable claim. The claim that suspending these programs was within its broad discretion to direct immigration policy. Apparently, the President can’t even manage his own immigration policies anymore.

“Public Interest” or Just Another Liberal Wish List?

The judge actually tried to justify this. She said it wasn’t in the “public interest” for these individuals to become “unlawfully present.” She worried they couldn’t “legally work.” It’s a familiar song, isn’t it? The bleeding hearts always find a reason to keep the floodgates open.

From ‘Fox News’:

“This court emphasizes, as it did in its prior order, that it is not in the public interest to manufacture a circumstance in which hundreds of thousands of individuals will, over the course of several months, become unlawfully present in the country, such that these individuals cannot legally work in their communities or provide for themselves and their families,” the judge wrote.

Manufacture a circumstance? The only thing being manufactured here is an excuse. An excuse to ignore the law. An excuse to undermine a President trying to secure our borders. Thankfully, the Justice Department sees it differently. When Talwani pulled a similar stunt back in April, regarding migrants from Cuba, Haiti, Nicaragua, and Venezuela, the DOJ pushed back hard. Axios reported the DOJ argued her order “blocks the Executive Branch from exercising its discretionary authority over a key aspect of the Nation’s immigration and foreign policy and thwarts Congress’s express vesting of that decision in the Secretary, not courts.” That’s lawyer-speak for “stay in your lane, judge.”

Déjà Coup? This Judge and Trump’s Policies Have Met Before

This isn’t Judge Talwani’s first rodeo. As mentioned, she already tried to block the administration’s efforts on the CHNV Program for Cuba, Haiti, Nicaragua, and Venezuela. The Trump administration rightly asked the Supreme Court to step in on that one. It seems some judges just can’t help themselves. They see a conservative policy they don’t like. They find a way to stop it. Never mind the Constitution. Never mind the will of the American people who elected President Trump to fix this mess.

It’s judicial activism, plain and simple. An unelected judge substituting her political preferences for the sound policy of an elected President. This isn’t about a “lengthy process,” as Talwani claims federal law requires. This is about obstruction. This is about one liberal judge trying to dictate national immigration policy for all 50 states. It’s an affront to our system of government. It’s a slap in the face to every voter who wanted stronger borders and a sane immigration system.

The White House Isn’t Backing Down, And Neither Should We

The good news? The Trump administration isn’t taking this lying down. White House Press Secretary Karoline Leavitt made it clear. The White House will “fight this in a court of law.” And they should. This is about more than just some parole programs. This is about whether we are a nation of laws, or a nation ruled by the whims of activist judges. It’s about whether the President, elected by the people, has the authority to secure our nation.

These Biden-era programs were a disaster. They were an open invitation. They undermined our sovereignty. President Trump is doing exactly what he promised. He’s trying to restore order. He’s putting America first. It’s high time judges remembered their role. They are supposed to interpret the law, not invent it. They are certainly not supposed to act as a shadow legislature, vetoing policies they personally dislike.

This fight matters. It matters for our security. It matters for the rule of law. It matters for the future of our Republic. We stand with President Trump as he fights this judicial overreach. We expect him to use every tool at his disposal. The American people are tired of seeing their clearly expressed will thwarted by those who think they know better.
