DOJ Sues California After State Refuses to Review 20,000 Suspected Noncitizens on Voter Rolls Ahead of Midterms

The right to vote is the foundation of everything in this country. It’s the one moment where every American citizen – rich, poor, famous, anonymous – holds equal power in shaping the republic. The Founders understood that, which is precisely why they anchored the franchise to citizenship. Your ballot carries weight because you carry the obligations and allegiance of belonging to this nation. Strip away that requirement, and the whole system unravels.

So here’s the uncomfortable question nobody in Sacramento wants to answer: what happens when a state government gets handed concrete evidence that thousands of noncitizens may be voting in its elections – and refuses to even glance at it? Not disputes it. Not investigates and clears the names. Simply refuses. The answer should make your blood run cold.

From The Epoch Times:

The Department of Justice (DOJ) filed a lawsuit against California on Oct. 15 over its voter list after finding more than 20,000 “likely noncitizens” registered to vote in the state, prosecutors announced.

First Assistant U.S. Attorney Bill Essayli in Los Angeles said the DOJ gave the state 48 hours to review the names of the suspected noncitizens registered to vote who were mailed live ballots and determine whether citizens were on the list.

Twenty thousand. Let’s sit with that number for a moment. Not a dozen clerical errors. Not a statistical hiccup in some backwater county. Twenty thousand likely noncitizens – identified by the Department of Homeland Security – who were mailed live ballots for the upcoming midterm elections. The DOJ didn’t demand California take their word for it. They asked the state to independently review the names, verify citizenship, and sequester any questionable ballots until the matter was settled.

California refused.

Two words from Essayli that tell you everything about Sacramento’s actual priorities. Democrats have spent the better part of a decade waving away noncitizen voting concerns as tinfoil-hat paranoia. Voter suppression hysteria, they called it. Right-wing fever dreams. But when the federal government arrives with 20,000 specific names and says “just check these,” the state that never stops preaching about democratic norms bolts the door and pretends nobody knocked.

Excuses that collapse on contact

The details of California’s refusal are, honestly, more revealing than the refusal itself. Acting Deputy Attorney General Trent McCotter personally delivered a password-protected thumb drive to Los Angeles County containing the flagged names. Dean Logan, the county’s registrar-recorder, wouldn’t touch it. His stated reason? The device didn’t meet “established data privacy and information security protocols.” Apparently a password-protected drive hand-delivered by the United States Department of Justice doesn’t clear the bar for California bureaucrats.

It gets better. Secretary of State Shirley Weber publicly dismissed the DOJ’s findings as “unsubstantiated claims” and insisted the department never even provided a list of names. Except – and this is important – the thumb drive was delivered. It contained the names. Weber’s office either had no idea what its own county officials received, or it knew perfectly well and chose to play dumb. Neither option inspires confidence.

When a state won’t open the envelope, the message writes itself. They don’t want answers because answers would demand action – and action would mean removing voters that reliably pull the lever for one party.

The Attorney General calls it what it is

AG Todd Blanche dispensed with the euphemisms: “State-facilitated voter fraud is unacceptable in the United States of America.” The DOJ’s lawsuit asks the court to block California from tabulating mail-in ballots cast by likely noncitizens until citizenship is verified. That’s not suppression. That’s the bare minimum.

This fight extends well beyond one state, too. Harmeet Dhillon’s Civil Rights Division has filed 31 lawsuits pressuring states to maintain clean voter rolls and sent warning letters to all 50 states that knowingly harboring noncitizen registrants could carry criminal consequences. California, with its staggering 20,000 flagged names, stands as the most brazen offender on the map.

The real cost lands on real citizens

Here’s what gets lost in the legal wrangling. Every single noncitizen ballot that slips through cancels out the vote of a lawful American. A retired nurse in Bakersfield. A Marine veteran in San Diego. A small business owner in Fresno who stood in line on a Tuesday morning because she believed her voice mattered. Their votes evaporate – neutralized not by some foreign adversary but by their own state government’s calculated indifference.

Ballots are already in the mail. The midterms are weeks away. And California will not verify whether 20,000 of its registered voters are even legally entitled to participate.

If the state had nothing to hide, they’d crack open that thumb drive in a heartbeat. They’d review every name. They’d relish the opportunity to prove the DOJ wrong and embarrass the administration in the process. Instead, they hired lawyers and shut the blinds.

The right to vote belongs to American citizens – no one else. When a state government spends more energy dodging that truth than defending it, they aren’t safeguarding democracy. They’re dismantling it from the inside.

Key Takeaways

  • The DOJ identified over 20,000 likely noncitizens registered to vote in California.
  • California refused to review the flagged names or sequester suspicious ballots.
  • Los Angeles County wouldn’t even open the thumb drive containing DHS evidence.
  • Every noncitizen ballot counted directly cancels a lawful American citizen’s vote.
